  1. HOW TO ENTER: The Back-to-School Beauty Sweepstakes (the “Sweepstakes”) begins at 4:00 p.m. Eastern Time (ET) on September 3, 2009 and ends at 11:59 PM ET on September 5, 2009 (the "Entry Period"). Members of the CoverGirl Text Club will be sent text messages offering the opportunity to enter the Sweepstakes (“Entry Texts”) on or about September 3, 2009 and September 5, 2009. To enter the Sweepstakes, reply by text message to the Entry Text and follow the additional entry instructions that will be provided. Standard carrier's messaging rates apply. By submitting an entry, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Sweepstakes. All entries must be submitted by 11:59 PM ET on September 5, 2009. No purchase necessary. Each entrant is responsible for all charges imposed by the entrant’s wireless service provider (as applicable), including any applicable taxes on such service, in connection with the submission of an entry. There is a limit of one (1) entry per person. Once a CoverGirl Text Club member has replied to an Entry Text, such member may not be sent additional Entry Texts. Any individual who attempts or otherwise encourages, directly or indirectly, the entry of multiple or false contact information under multiple identities or who otherwise engages in conduct that undermines the integrity of the Sweepstakes, as determined by The Procter & Gamble Distributing LLC ("Sponsor"), will be disqualified. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, misdirected, corrupted or garbled entries, which will be disqualified. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
  2. ELIGIBILITY: This sweepstakes is open only to legal residents of the fifty United States (excluding residents of the State of Maine) and the District of Columbia who are 13 years of age or older and who are members of the CoverGirl Text Club as of the date of entry. Employees of Sponsor, its subsidiaries, affiliates, distributors and advertising, promotion and Internet agencies, and their immediate family and household members, are not eligible. Void where prohibited by law. In the event of a dispute regarding the identity of any entrant, the entry will be deemed made by the authorized account holder of the telephone number or pager number submitted at the time of entry (i.e., the natural person who is assigned to a telephone number or pager number by a telephone company, wireless service provider or other organization responsible for assigning telephone numbers, wireless phone numbers or pager numbers, as applicable, for the telephone exchange associated with the submitted telephone or pager number, as applicable).
  3. WINNER SELECTION: Two (2) potential Grand Prize winners will be selected in random drawings conducted by the Sponsor, whose decisions are final with respect to all matters relating to this sweepstakes, on or about September 10, 2009. One (1) Grand Prize winner will be selected from among all eligible entries received as of the close of the Entry Period in response to the first Sweepstakes Text, one (1) Grand Prize winner will be selected from among all eligible entries received as of the close of the Entry Period in response to the second Sweepstakes Text. Limit one prize per person. Odds of winning depend on the number of eligible entries received in response to each Sweepstakes Text. Each potential Grand Prize winner will be notified by e-mail, standard mail and/or telephone, at Sponsor's discretion. If any potential winner cannot be reached by e-mail or telephone within three (3) days of initial attempt and/or fails to respond to any notification attempt within three (3) days, or if any attempted notification or prize delivery is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner. The potential Grand Prize winner will be required to complete and return to Sponsor an Affidavit of Eligibility/Release of Liability, and, if legally permissible, a Publicity Release within five (5) days of attempted delivery of same. If the potential winner is a minor under the laws of his or her state of residency, prize will be awarded in the name of the winner's parent or legal guardian, who will be required to complete the Affidavit/Release. Failure to complete and return any required affidavit or release within the specified time period will result in disqualification and an alternate winner will be selected.
  4. PRIZES: Each Grand Prize is $1,000.00, awarded in the form of a gift card or check, in Sponsor’s discretion. Approximate retail value ("ARV") of each Grand Prize is $1,000.00. The total ARV of all prizes is $2,000.00. Each prize consists only of the item expressly specified in these Official Rules. All expenses and costs associated with the acceptance or use of any prize are the responsibility of the winner. Use of gift cards is subject to card issuer’s terms and conditions. Restrictions may apply. All prizes will be awarded if properly claimed. No substitution, cash redemption or transfer of right to receive prize permitted, except in the discretion of Sponsor, which reserves the right to substitute a prize of equal or greater value. All federal, state and local taxes on prize value are the sole responsibility of winner. An IRS form 1099 will be issued in the name of each Grand Prize winner.
  5. GENERAL RULES: Sponsor is not responsible for late, lost, delayed, illegible, damaged, corrupted or incomplete entries, incorrect or inaccurate capture of, damage to, or loss of entries or entry information, or any other human or technical errors of any kind relating to the submission, collection, storage or processing of entries or the administration of the sweepstakes. Sponsor assumes no responsibility for undeliverable text messages or for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail. Sponsor is not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, modify or suspend this sweepstakes should a virus, bug, technical failure or problem, entrant fraud or misconduct or other cause(s) beyond the reasonable control of Sponsor, in Sponsor’s determination, corrupt the administration, integrity, security or proper operation of the sweepstakes. In the event of termination of the sweepstakes, a notice will be posted online and a random drawing to award the prizes will be conducted from among all eligible entries received prior to the time of termination. All federal, state and local laws and regulations apply. By entering, entrants release and agree to hold Sponsor, its parent companies, affiliates, subsidiaries, distributors, agents, successors and licensees, and all other companies involved in any manner in the Sweepstakes, and each of their directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of participation in the sweepstakes or use of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, each entrant agrees by entering the sweepstakes that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action, in a federal or state court located in New York, NY, (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees, and (c) under no circumstances will any entrant be permitted to obtain any award for, and each entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. The Sweepstakes is governed by, and will be construed in accordance with, the laws of the State of New York, without giving effect to conflict of laws principles. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this sweepstakes or use or redemption of any prize. Acceptance of prize constitutes permission for the Sponsor and its parent companies, affiliates, subsidiaries, agents, distributors, successors and licensees to use winner's name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. All entries become the sole property of Sponsor and will not be returned. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of Sponsor, which are final and binding in all respects. Sponsor is not responsible for and shall not have any liability for any typographical or other error in the printing of the offer, administration of the sweepstakes or in the announcement of any prize. In no event will more than the number of prizes stated in these Official Rules be awarded.
